1. Acceptance of these terms
These Terms of Use (“Terms”) are a binding agreement between you and Tri-Source Group LLC, a Florida limited liability company, which operates the SpotBureau brand (“SpotBureau,” “we,” “us,” or “our”). By accessing or using the SpotBureau website and related services (the “Services”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Who we are & the Services
SpotBureau aggregates public-record data from many sources to help businesses and individuals search, discover, and resolve compliance, tax, and property-ownership questions. The Services include free look-up tools for individuals and paid platform features and products for business. Some products — including Pinrates and SpotUs — are offered through separate websites with their own terms.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that your use complies with all applicable laws.
4. Accounts
Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Free lookups & paid services
Certain look-up tools are offered free of charge for personal, informational use. Paid platform features and products are governed by these Terms together with any order form, subscription, or product-specific terms you agree to. Fees, billing, and cancellation terms for paid services are as described at the point of purchase.
6. Acceptable use
You agree not to:
- use the Services in violation of any applicable law or regulation;
- scrape, harvest, crawl, or bulk-download data except as expressly permitted, or circumvent access controls or usage limits;
- resell, sublicense, or redistribute data from the Services without our authorization;
- use the Services to harass, stalk, defraud, or harm any person, or to make unlawful decisions about any individual;
- interfere with or disrupt the integrity or performance of the Services, or attempt to gain unauthorized access to any systems; or
- misrepresent your identity or your permitted purpose for accessing data.
7. Permissible use of public-record data
SpotBureau is not a consumer reporting agency as defined by the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et seq., “FCRA”), and the public-record data provided through the general Services is not a “consumer report.”
You may not use the Services, or any data obtained from them, in whole or in part as a factor in establishing an individual’s eligibility for credit or insurance, employment, housing or tenancy, or for any other purpose regulated by the FCRA or any comparable state law. You are solely responsible for using the data in a lawful manner and for a permissible purpose.
Certain products offered through separate sites (for example, compliance or verification products) may operate under their own terms and purpose-of-use requirements; where they do, those terms control for that product.
8. Intellectual property
The Services, including their design, text, graphics, software, and the selection, arrangement, and resolution of data, are owned by Tri-Source Group LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose and subject to these Terms. All rights not expressly granted are reserved. SpotBureau, Pinrates, MineralGraph, and SpotUs are marks of Tri-Source Group LLC.
9. Third-party products & links
The Services reference and link to third-party products and websites, including the separately operated pinrates.com and spotus.com. We do not control and are not responsible for third-party content, products, or practices, and your use of them is governed by their own terms and policies.
10. Disclaimers
The Services and all data are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Public-record data originates with third-party sources and may be incomplete, inaccurate, or out of date; we do not warrant its accuracy, completeness, or timeliness.
The Services do not provide legal, tax, financial, or professional advice, and nothing on the Services should be relied upon as such. You are responsible for verifying information and obtaining professional advice before acting.
11. Limitation of liability
To the fullest extent permitted by law, Tri-Source Group LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim or one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Tri-Source Group LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party — including any use of data in violation of Section 7.
13. Governing law & disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts, except where applicable law provides otherwise.
14. Changes
We may modify the Services or these Terms from time to time. When we change these Terms, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or others. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
